Voice Usage Policy

1. Introduction

This Voice Usage Policy governs the use of voice generation, voice cloning, speech synthesis and related voice features made available through Lumesoon.

This Policy forms part of the Lumesoon Terms of Service.

By accessing or using any voice feature, you agree to comply with this Policy.

Failure to comply may result in warnings, feature restrictions, suspension, termination of your account, removal of voice models, cancellation of subscriptions or other actions permitted under our Terms of Service.

2. Scope

This Policy applies to all voice-related features provided by Lumesoon, including:

• Voice cloning.
• Voice generation.
• Speech synthesis.
• Voice previews.
• Custom voice models.
• Voice uploads.
• Audio generation.
• API access to voice features.
• Future voice services introduced by Lumesoon.

3. User Responsibility

You are solely responsible for every voice recording uploaded, generated or shared through your account.

You must ensure that your use of voice features complies with:

• Applicable laws.
• Intellectual property rights.
• Privacy rights.
• Publicity rights.
• Contractual obligations.
• This Policy.
• The Terms of Service. Lumesoon does not verify ownership of uploaded voice recordings before processing them.

4. Consent Requirements

You may upload a voice recording only if:

• It is your own voice, or
• You have obtained clear, valid and lawful permission from the individual whose voice is being used. You are responsible for obtaining and maintaining evidence of that permission.

Lumesoon may request reasonable evidence of consent during investigations.

Failure to provide sufficient evidence may result in suspension or termination of your account.

5. Ownership of Voice Recordings

You retain ownership of voice recordings that you lawfully upload to Lumesoon.

By uploading voice recordings, you grant Lumesoon a limited, non-exclusive, worldwide, royalty-free license to process, store, reproduce and transmit those recordings solely for the purpose of providing the requested Services, maintaining platform security, improving service reliability and complying with applicable legal obligations.

This license ends when your recordings are permanently deleted from our systems, except where retention is required by law, backup procedures, fraud investigations or enforcement of our legal rights.

6. Ownership of Generated Audio

Subject to your compliance with these Terms and any applicable third-party rights, you retain your rights in audio generated using your own lawful inputs.

Lumesoon does not claim ownership of your generated audio solely because it was created using our Services.

You remain responsible for ensuring that your generated audio does not infringe the rights of others.

7. Commercial Use

Unless expressly restricted by Lumesoon or the applicable voice provider, audio generated through Lumesoon may be used for personal or commercial purposes, subject to this Policy, the Terms of Service and any additional licensing terms that apply to the selected voice model:

• You have all required rights to the source materials.
• Your use complies with applicable law.
• Your use complies with this Policy.
• Your use does not infringe the rights of any third party. Certain third-party or licensed voice models may be subject to additional restrictions, which will apply where identified.

8. Prohibited Voice Activities

You must not use Lumesoon voice features to:

• Clone a voice without authorization.
• Impersonate another individual.
• Commit fraud.
• Mislead the public.
• Circumvent identity verification.
• Produce deceptive financial communications.
• Produce deceptive legal communications.
• Produce deceptive medical communications.
• Produce fake emergency announcements.
• Falsely represent endorsements.
• Create unlawful recordings.
• Harass or threaten others.
• Violate court orders.
• Infringe intellectual property rights.
• Violate privacy rights.
• Violate publicity rights. Users remain solely responsible for all generated voice content.

9. Public Figures

The voices of public figures, celebrities and other recognizable individuals may be protected by publicity rights, privacy rights, contractual obligations or other applicable laws.

You are responsible for ensuring that your use of such voices complies with all applicable legal requirements.

Availability of a voice feature does not imply permission to clone or use any person's voice.

10. Misrepresentation

You must not use generated voices to falsely represent that audio:

• Was spoken by another person.
• Was officially issued by a government.
• Was issued by a court.
• Was issued by a law enforcement agency.
• Was issued by a financial institution.
• Was issued by a healthcare provider.
• Was issued by any organization without authorization. Where generated audio is likely to cause confusion, users are encouraged to make appropriate disclosures where required by applicable law.

11. Uploaded Recordings

You must ensure that uploaded recordings:

• Are lawfully obtained.
• Do not infringe copyright.
• Do not violate privacy rights.
• Do not violate contractual restrictions.
• Do not contain malicious software.
• Do not violate this Policy or applicable law. Lumesoon reserves the right to remove recordings that reasonably appear to violate this Policy.

12. Voice Quality

Generated voices may vary depending on:

• Recording quality.
• Recording length.
• Audio clarity.
• Background noise.
• User settings.
• Selected voice engine.
• Technical limitations. Lumesoon does not guarantee that generated voices will perfectly reproduce any particular voice or meet every user's expectations.

13. Third Party Voice Engines

Some voice features may rely on technology or infrastructure provided by third parties.

Availability, quality and functionality may vary.

Lumesoon is not responsible for interruptions, limitations or changes arising from third-party voice technologies.

14. Voice Storage

Voice recordings and generated audio may be stored for as long as reasonably necessary to:

• Deliver requested Services.
• Maintain project history.
• Improve service reliability.
• Maintain backups.
• Detect fraud.
• Resolve disputes.
• Comply with legal obligations. Retention periods may vary depending on the Service and applicable legal requirements.

15. Voice Deletion

Where supported by the Services, users may delete voice recordings and related projects through their accounts.

Deletion requests may be limited where retention is reasonably necessary to:

• Comply with legal obligations.
• Resolve disputes.
• Prevent fraud.
• Protect platform security.
• Enforce our agreements.
• Maintain backup integrity. Deletion from active systems may not immediately remove information from encrypted backup systems.

16. Investigation of Misuse

Lumesoon may investigate suspected misuse of voice features.

Investigations may include review of:

• Uploaded recordings.
• Account activity.
• Voice generation history.
• API activity.
• Security logs.
• Fraud indicators.
• Customer reports. Investigations will be limited to what is reasonably necessary to protect the Services, users and our legal interests.

17. Enforcement

Where Lumesoon reasonably determines that this Policy has been violated, we may:

• Remove recordings.
• Remove generated audio.
• Suspend voice features.
• Restrict API access.
• Suspend subscriptions.
• Terminate accounts.
• Cancel affiliate participation.
• Report unlawful conduct where permitted or required by law. The enforcement action taken will depend on the seriousness and frequency of the violation.

18. No Verification Obligation

Lumesoon is not required to verify the ownership, authenticity or legality of every uploaded recording before processing it.

Users remain solely responsible for ensuring they possess all necessary rights and permissions.

19. Limitation of Responsibility

Lumesoon provides voice technologies as tools.

Lumesoon is not responsible for:

• How users choose to use generated audio.
• Statements made using generated voices.
• Unauthorized uploads.
• False claims of ownership.
• Misrepresentation by users.
• Infringement caused by users.
• Commercial decisions based on generated audio. Users accept full responsibility for their use of voice-related features.

20. Indemnification

You agree to defend, indemnify and hold harmless Lumesoon, its owners, affiliates, employees, contractors and service providers from claims arising from:

• Your uploaded recordings.
• Your generated audio.
• Unauthorized voice cloning.
• Failure to obtain consent.
• Intellectual property infringement.
• Privacy violations.
• Publicity rights violations.
• Your violation of this Policy or applicable law. This obligation survives termination of your account.

21. Changes to This Policy

Lumesoon may update this Voice Usage Policy from time to time.

Updated versions become effective upon publication unless otherwise stated.

Where required by applicable law, appropriate notice of material changes will be provided.

Continued use of voice features after the updated Policy becomes effective constitutes acceptance of the revised Policy.

22. Relationship With Other Policies

This Voice Usage Policy should be read together with the Terms of Service, Privacy Policy, Refund Policy and Acceptable Use Policy.

Where another policy imposes additional obligations relating to voice features, those obligations also apply.

23. Reservation of Rights

Except where prohibited by applicable law, Lumesoon reserves all rights not expressly limited by this Policy.

Failure to exercise any right under this Policy does not constitute a waiver of that right.

24. Severability

If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
