Lumesoon respects the intellectual property rights of others and expects all users of the Services to do the same.
This Copyright Policy explains how copyright concerns are handled on the Lumesoon platform, including the reporting of alleged copyright infringement, the review process and actions that may be taken where violations are identified.
This Policy forms part of the Lumesoon Terms of Service.
By using the Services, you agree to comply with this Copyright Policy.
2. Scope
This Policy applies to all content submitted, uploaded, generated, stored or shared through Lumesoon, including:
- Text.
- Audio.
- Voice recordings.
- Voice models.
- Images.
- Documents.
- Meeting recordings.
- Generated content.
- API submissions.
- Project files.
- Any other material processed through the Services.
3. Intellectual Property Ownership
Users retain ownership of content they lawfully upload to Lumesoon.
Nothing in this Policy transfers ownership of user content to Lumesoon.
Lumesoon retains ownership of its website, software, applications, trademarks, logos, platform design, source code, documentation and all other proprietary technology.
Except as expressly permitted, no rights are granted to copy, distribute, reproduce or commercially exploit any Lumesoon intellectual property.
4. User Responsibilities
Before uploading or processing any content, you must ensure that you have the legal right to use it.
You represent and warrant that:
- You own the content, or
- You have obtained all necessary licenses, permissions or authorizations. You remain solely responsible for verifying that your use of content does not infringe the rights of any third party.
5. Prohibited Infringement
You must not use the Services to:
- Upload copyrighted material without authorization.
- Reproduce copyrighted works without permission.
- Distribute copyrighted material unlawfully.
- Remove copyright notices.
- Circumvent copyright protection measures.
- Misrepresent ownership of another person's work.
- Infringe trademarks, patents, trade secrets or other intellectual property rights.
6. Copyright Complaints
If you believe that content available through Lumesoon infringes your copyright, you may submit a copyright complaint through the official contact methods published on the Lumesoon website.
To help us investigate efficiently, your notice should include:
- Your full name.
- Contact information.
- Identification of the copyrighted work.
- Identification of the allegedly infringing material.
- Information sufficient for us to locate the material.
- A statement explaining your ownership or authority.
- A statement that the information provided is accurate to the best of your knowledge. Lumesoon may request additional information where reasonably necessary to verify the complaint.
7. Review Process
Upon receiving a copyright complaint, Lumesoon may:
- Review the complaint.
- Request additional information.
- Contact the reporting party.
- Contact the affected user.
- Temporarily restrict access to the reported material.
- Remove the reported material where appropriate.
- Reject incomplete or unsupported complaints. Submission of a complaint does not automatically result in removal of content.
8. Counter Notification
If your content is removed or restricted following a copyright complaint and you believe the complaint was made in error, you may submit a counter notification.
A counter notification should include:
- Your name.
- Contact information.
- Identification of the affected material.
- A statement explaining why you believe the complaint was incorrect.
- Any supporting documentation reasonably available. Lumesoon may review the counter notification and take any action it considers appropriate after completing its review.
9. Repeat Infringers
Lumesoon reserves the right to suspend or permanently terminate accounts involved in repeated copyright infringement.
When determining whether repeated infringement has occurred, Lumesoon may consider:
- Previous complaints.
- Previous removals.
- Previous warnings.
- Evidence provided.
- The seriousness of violations.
- Whether the conduct appears intentional. Repeated infringement may result in permanent loss of access to the Services.
10. Good Faith Requirement
Copyright complaints and counter notifications must be submitted in good faith.
Knowingly submitting false, misleading or fraudulent claims may result in:
- Rejection of the submission.
- Account restrictions.
- Suspension.
- Termination.
- Other action permitted by applicable law.
11. Temporary Restrictions
While a complaint is being investigated, Lumesoon may temporarily:
- Restrict access to content.
- Suspend downloads.
- Suspend sharing.
- Disable public access.
- Restrict related features. Temporary restrictions do not imply that infringement has occurred.
12. Preservation of Evidence
Where reasonably necessary, Lumesoon may preserve relevant records during a copyright investigation.
Such records may include:
- Account information.
- Upload history.
- Project history.
- Activity logs.
- Security records.
- Technical information. Records are retained only as reasonably necessary to investigate complaints, comply with legal obligations or protect legal rights.
13. Third Party Rights
Some content processed through Lumesoon may also be subject to:
- Trademark rights.
- Publicity rights.
- Privacy rights.
- Contractual rights.
- Patent rights.
- Other intellectual property protections. Users remain responsible for complying with all applicable rights, not only copyright.
14. Generated Content
Lumesoon provides tools that generate content based on user inputs.
Users are solely responsible for reviewing generated output before publishing, distributing or relying upon it.
Lumesoon does not guarantee that generated content:
- Is original.
- Is free from third-party rights.
- Does not resemble existing works.
- Is suitable for commercial use without further review. Users are responsible for obtaining independent legal advice where necessary before using generated content commercially.
15. Voice Recordings
Users uploading voice recordings must ensure they possess all necessary rights to use those recordings.
Uploading a recording does not transfer ownership of the recording to Lumesoon.
Voice recordings remain subject to the Voice Usage Policy and Terms of Service.
16. Cooperation With Rights Holders
Where appropriate and permitted by applicable law, Lumesoon may cooperate with copyright owners, legal representatives and regulatory authorities when investigating alleged intellectual property infringement.
17. Limitation of Responsibility
Lumesoon provides technology that enables users to process content.
Lumesoon does not pre-screen every uploaded file or generated project.
Accordingly, Lumesoon is not responsible for:
- Unauthorized uploads by users.
- False ownership claims.
- Copyright infringement committed by users.
- Commercial use of generated content.
- Decisions made using generated content. Users remain solely responsible for ensuring they possess all required rights before using the Services.
18. Indemnification
You agree to defend, indemnify and hold harmless Lumesoon, its owners, employees, affiliates, contractors and service providers from claims arising from:
- Your uploaded content.
- Your generated content.
- Copyright infringement.
- Trademark infringement.
- Patent infringement.
- Privacy violations.
- Publicity rights violations.
- Misrepresentation of ownership.
- Violation of this Policy. This obligation survives termination of your account.
19. Enforcement
Where Lumesoon reasonably determines that this Policy has been violated, we may:
- Remove content.
- Restrict access.
- Suspend accounts.
- Remove voice models.
- Disable APIs.
- Suspend subscriptions.
- Terminate accounts.
- Preserve evidence where appropriate.
- Report unlawful conduct where required or permitted by applicable law. The action taken will depend on the seriousness and frequency of the violation.
20. Changes to This Policy
Lumesoon may update this Copyright Policy from time to time.
Updated versions become effective upon publication unless otherwise stated.
Where required by applicable law, appropriate notice of material changes will be provided.
Continued use of the Services after the updated Policy becomes effective constitutes acceptance of the revised Policy.
21. Relationship With Other Policies
This Copyright Policy should be read together with the Terms of Service, Privacy Policy, Acceptable Use Policy and Voice Usage Policy.
Where another policy contains additional obligations relating to intellectual property, those obligations also apply.
22. Reservation of Rights
Except where prohibited by applicable law, Lumesoon reserves all rights not expressly limited by this Policy.
Failure to exercise any right under this Policy shall not constitute a waiver of that right.
23. Severability
If any provision of this Policy is determined to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
